  An exception may exist, and we may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Comply with regulatory required retention period(s).
  10. Make other internal and lawful uses of that information that is compatible with the context in which you provided it.

  How to Exercise Your Rights. To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

  Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

  We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

  We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

  Response Timing and Format. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option.

  Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

  We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

  Non-Discrimination. We do not discriminate against California residents who exercise any of their rights described in this Addendum.

You may opt out of any: (i) data sharing or sale of your personal information; (ii) targeted advertising; (iii) profiling activities; or (iv) use of your personal information for third party analytics purposes, by sending a request to opt out to info@saracenresort.com.

Opting out may affect your ability to receive information from Play Saracen 4 Fun or to access our services.

Under the Virginia Consumer Data Protection Act (VCDPA), you may request that we (as the controller of your personal data): (i) Confirm if we are actually processing their personal data; (ii) Correct inaccuracies in the consumer’s personal data that is collected by us; (iii) Delete personal data provided by or obtained about you; (iv) Obtain copies of the personal data collected by us; or (v) Opt out of the processing of personal data for purposes of targeted advertising, the sale of personal data, or further profiling.

You have the right to have your data, kept or maintained by us, deleted permanently from our system and databases subject to limited exceptions. To do this, please send an email to support@saracenresort.com and let us know that you want to erase your personal data collected by us deleted from your account. Please note that once your data is deleted you will not be able to retrieve it, and all account information will be deleted permanently. This also means you will not be able to merge your deleted account information to a different account in the future.

The Play Saracen 4 Fun site may offer social sharing features and other integrated tools (such as the Twitter “Tweet” button), which will let you share actions you take on the site with other media. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. For more information about the purpose and scope of data collection and processing in connection with such social sharing features, please visit the privacy policies of the entities that provide these features.

If you use the message boards, leaderboards, chat rooms, comment tools, or other public forums of the site, you will be publicly identified by your screen name and other player content you submit. Additionally, when you participate in certain promotions or tournaments offered through the Site (e.g., a leaderboard promotion), we may also identify you by your screen name. Your screen name and all information you provide on these public forums will be viewable by the general public. Your screen name will be either the content of the email address associated with your account preceding the ‘@’ symbol, or such other screen name chosen by you in accordance with our terms of service. We cannot be responsible for any personal or sensitive information in your screen name or which you choose to post on public forums and we recommend careful consideration before you include any personal or sensitive information in your screen name or otherwise post such information. You agree that you will not disclose personal or sensitive information relating to any other person in a public forum of the site without that person’s prior consent. WE ARE NOT RESPONSIBLE FOR A USER’S MISUSE OR MISAPPROPRIATION OF ANY USER CONTENT YOU POST TO THE SERVICES.

We may update this Privacy Policy. The *"Last Updated" *date at the top of this page indicates when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when the updated Privacy Policy is posted.

This Privacy Policy and all related matters shall be governed by, and construed and enforced in accordance with, the laws of the State of Arkansas, without regard to conflict of law principles.
